Terms of Service

These Terms of Service ("Terms") govern your use of the Gigavent mobile application and website (together, the "Platform"), operated by Polycrunch Tech Private Limited ("Gigavent", "we", "us"). By creating an account or using the Platform, you agree to these Terms.

1. What Gigavent is

Gigavent is a marketplace that connects people who want to attend events ("Attendees") with people who organise them ("Hosts"). We provide the technology to discover events, book tickets, communicate, and process payments. Gigavent is not the organiser of events listed by Hosts and is not responsible for the conduct of an event itself.

2. Eligibility & accounts

You must be at least 18 years old to use Gigavent. You are responsible for the accuracy of the information in your account and for keeping your login secure. You may delete your account at any time from within the app.

3. Booking tickets

• When you book a ticket, you enter into a transaction with the Host, facilitated by Gigavent.
• Paid ticket payments are collected securely through our payment partner, Razorpay, and are held until the event concludes.
• Your ticket is delivered as a QR code in the app and is validated at entry by the Host.
• Tickets are for personal use and may not be resold without the Host's permission.

4. Hosting events

• To list events, Hosts must complete identity verification (KYC), including government ID and, for paid events, bank details for payouts.
• A flat listing fee of ₹49 is charged when an event is published. This fee is non-refundable once the event is live.
• For paid events, Gigavent charges a platform fee of 10% of ticket revenue. Free events incur no platform fee.
• Hosts are solely responsible for delivering the event as described, for its safety and legality, and for complying with all applicable laws and permissions.
• Hosts must not list events that are illegal, unsafe, fraudulent, discriminatory, or that promote hate, violence, or harm.

5. Host payouts

For paid events, ticket funds (less the 10% platform fee) are released to the Host's Gigavent wallet after the event concludes, and may then be withdrawn to the Host's verified bank account. If an event is cancelled, funds are refunded to Attendees before any payout is made.

6. Cancellations & refunds

Cancellations and refunds are governed by our Refunds & Cancellations Policy, which forms part of these Terms.

7. Acceptable use

You agree not to misuse the Platform, including by posting false information, harassing others, attempting to defraud Hosts or Attendees, or interfering with the Platform's operation. We may suspend or remove accounts and content that violate these Terms.

8. Content & group chats

You are responsible for content you post, including in event group chats. Do not share unlawful, abusive, or infringing content. We may remove content and report unlawful activity to authorities.

9. Limitation of liability

Gigavent provides the Platform on an "as is" basis. To the fullest extent permitted by law, we are not liable for the conduct, safety, quality, or outcome of any event, which is the responsibility of the Host. Our total liability in connection with the Platform is limited to the fees you paid to us in the preceding three months.

10. Changes

We may update these Terms from time to time. Material changes will be notified in the app or by email. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of Himachal Pradesh, India.
